Loyalty Club Terms and Conditions

Rodd & Gunn USA INC (“Rodd & Gunn,” “we,” “us,” or “our”) may provide you with the opportunity to participate in our Loyalty Club, under which you may earn discounts, coupons, early access to sales and promotions, and various complimentary services (collectively, “Perks”) depending on your level of membership.  The way in which our Loyalty Club works, and the terms and conditions governing our Loyalty Club and your participation in it (the “Loyalty Club Terms”), are described below.

By participating in the Loyalty Club, you agree to these Loyalty Club Terms.  These Loyalty Club Terms complement and incorporate by reference our Terms and Conditions, available at http://us.roddandgunn.com/pages/terms-of-use (the “Terms of Use”), and our Privacy Policy, available at http://us.roddandgunn.com/pages/privacy-policy. In the event of any conflict between these documents, the conflict will be resolved in the following descending order of precedence: Terms of Use, Privacy Policy, and Loyalty Club Terms.

THE SECTION BELOW TITLED “GENERAL INFORMATION” CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER.  THEY AFFECT YOUR LEGAL RIGHTS.  PLEASE READ THEM.

Changes to the Loyalty Club Terms

We reserve the right to change these Loyalty Club Terms at any time with or without prior notice. We may terminate the Loyalty Club Terms at any time for any reason. If the Loyalty Club is terminated, you may continue to use any coupons you received as a member of the Loyalty Club in accordance with the terms of that coupon up until its expiration date, but all other Perks will end and no longer be available to you as of the effective date of termination of the Loyalty Club.

We may give you notice of changes to these Loyalty Club Terms by posting an updated version of this page at http://us.roddandgunn.com/pages/loyalty-terms-conditions or via e-mail.

You understand and agree that by participating in the Loyalty Club that we can make these changes at any time, with or without notice.

Registration for the Loyalty Club

The Loyalty Club is intended for personal use only. Commercial use is prohibited. This program is not targeted towards, nor intended for use by, anyone under the age of 13. If you are between the ages of 13 and 18, you may participate in the Loyalty Club only under the supervision of a parent or legal guardian, who agrees to be bound by these Loyalty Club Terms.

You may join our Loyalty Club when you make a Rodd & Gunn purchase in one of our U.S. retail stores (each, a “Retail Lodge”). You may choose to receive a loyalty card to participate in the Loyalty club. In our Retail Lodges, you may present the loyalty card, your name, or email address at the time of purchase to connect your purchase with your Loyalty Club account. If you have any questions or concerns regarding the Loyalty Club, you may contact our customer service department by e-mailing us at loyalty@roddandgunn.com.

Each time you make a purchase in one of our Retail Lodges, you may use your loyalty card, name, email address to track those purchases. The Loyalty Club tiers described below are based on the amount you spend in any 12-month period in our Retail Lodges.

There is no fee to enroll in the Loyalty Club.  Perks accumulated under the program are promotional and have no cash value.

Our Loyalty Club is currently only available in one of our Retail Lodges. Accessing the Loyalty Club online at http://us.roddandgunn.com/ (our "Site") is under development and will be available to our customers in the near future, along with our new mobile application (our "App).

Loyalty Tiers

The Loyalty Club has 3 tiers of membership: the Loyalty Tier, the Gold Tier, and the Platinum Tier. Criteria for membership in each tier, and the related Perks you will receive with that tier of membership, are described below.

Loyalty Tier

Each Rodd & Gunn customer who signs up for the Loyalty Club starts as a Loyalty Tier member. As a Loyalty Tier member, you will receive:

Gold Tier

If you spend $2,000 (USD) or more in any 12-month period in our Retail Lodges as a Loyalty Tier member, then you will be eligible for upgrade to lifetime Gold Tier status. As a Gold Tier member, you will receive:

Platinum

If you spend $5,000 (USD) or more in any 12-month period in our Retail Lodges as a Loyalty or Gold Tier member, then you will be eligible for upgrade to lifetime Platinum Tier status. As a Platinum Tier member, you will receive:

Spending Requirements

The spending requirements to achieve the Gold and Platinum Tiers will be tallied on purchases in our Retail Lodges after discounts have been applied, but inclusive of applicable sales tax. Rodd & Gunn wholesale purchases are not eligible for participation in the Loyalty Club and will not be counted toward any spending requirement.

Tailoring Services

If you are eligible for free tailoring services as part of your Loyalty Club membership tier, such free tailoring services will include the hemming of pants and cuffs of jackets for all non-sale products bought in a Retail Lodge only. All tailoring services must be arranged by a member of our Retail Lodge team with a tailor appointed by the Retail Lodge.

Information We Collect Through the Loyalty Club and How We Use It

We may contact you regarding the Loyalty Club at the phone numbers (through phone calls or text messages), e-mail addresses and postal addresses you have provided or provide to us, subject to the terms of our Privacy Policy. By agreeing to these Loyalty Club Terms, you consent to Rodd & Gunn using the information you provide to us (or that we collect as part of the Loyalty Club) in accordance with our Privacy Policy, and to your information being shared among our Retail Lodges. Rodd & Gunn and its affiliates may send you text messages at the phone numbers you provide to us, and you hereby consent to us sending you such text messages. Your wireless carrier may charge fees for text messages to your mobile device. Text messages may be sent to you multiple times per week. Message and data rates may apply. Text HELP for help. You may elect to no longer receive text messages from Rodd & Gunn and its affiliates by texting STOP. Your opt-out for text messages will be effective when you receive an opt-out confirmation.

General Information

Your Loyalty Club membership is personal to you and may not be sold, transferred, or assigned to, or shared with others, or used by you for any commercial purpose, except as described below. You may have only one Loyalty Club membership account that is personal to you. However, you may share your Loyalty Club membership with your immediately family.

IF HOWEVER, THERE IS AN ISSUE, CLAIM, OR DISPUTE THAT NEEDS TO BE RESOLVED, AND WE ARE UNABLE TO RESOLVE IT INFORMALLY, IT MUST BE RESOLVED THROUGH FINAL, BINDING ARBITRATION, AS SET FORTH IN OUR TERMS OF USE. THIS OBLIGATION APPLIES REGARDLESS OF WHETHER THE ISSUE, CLAIM, OR DISPUTE INVOLVES A TORT, FRAUD, BREACH OF CONTRACT, MISREPRESENTATION, PRODUCT LIABILITY, NEGLIGENCE, VIOLATION OF A STATUTE, OR ANY OTHER LEGAL THEORY.  INCLUDED ARE ALL ISSUES, CLAIMS, AND DISPUTES ARISING OUT OF OR RELATING TO ANY ASPECT OF YOUR PARTICIPATION IN THE LOYALTY CLUB, WHETHER ARISING DURING OR AFTER YOUR PARTICIPATION IN THE LOYALTY CLUB. AS SET FORTH IN OUR TERMS OF USE, ALL ARBITRATIONS SHALL BE CONDUCTED ON AN INDIVIDUAL (AND NOT A CLASS-WIDE) BASIS, AND AN ARBITRATOR SHALL HAVE NO AUTHORITY TO AWARD CLASS-WIDE RELIEF.  YOU ACKNOWLEDGE AND AGREE THAT THIS SPECIFICALLY PROHIBITS YOU FROM COMMENCING ARBITRATION PROCEEDINGS AS A REPRESENTATIVE OF OTHERS OR JOINING IN ANY ARBITRATION PROCEEDINGS BROUGHT BY ANY OTHER PERSON.
